Saiosh Comments - Draft Physical Agents Regulations 2022

The Minister of Employment and Labour (DEL), on 21 October 2022, published the Draft Physical Agents Regulations 2022 (PAR) for public comments. Saiosh circulated the Draft PAR to all members and arranged a webinar presentation by the relevant officials from the DEL.

Saiosh established a Saiosh Technical Committee (STC) to review the Draft PAR. The STC consists of Occupational Health and Safety Professionals, Occupational Hygienists, Occupational Health Medical Practitioners, Occupational Health and Safety Legal Practitioners as well as representatives of Approved Inspection Authorities. It took approximately 160 person-hours for Saiosh to complete the comments. The Saiosh comments, and a covering letter, were submitted to the DEL on 12 January 2022.

In our covering letter, Saiosh appealed to the DEL to carefully consider our comments and recommendations as the Draft PAR in its current format will make it near impossible for leading Corporates in South Africa to comply with, there is no possibility of South African SMME’s achieving compliance.
