NOTICE REGARDING APPLICATION OF THE CONSTRUCTION REGULATIONS 2014
OCCUPATIONAL HEALTH AND SAFETY ACT, 1993 CONSTRUCTION REGULATIONS, 2014

Under section 40(3)(b) of the Occupational Health and Safety Act, 1993 (Act No. 85 of 1993), I, Thobile Lamati, appointed as chief inspector in terms of section 27(1) of the said Act, and by virtue of the powers delegated to me by the Minister of Labour, in terms of section 42(1) of the said Act, hereby grant the following temporary exemptions in terms of section 40 of the said Act:

1. All construction works where physical construction started after the 7th of February 2014 must comply with the Construction Regulations 2003, and such construction works are exempted to comply with the Construction Regulations 2014 until the 7th August 2014, 6 months after the commencement of these Regulations, thereafter the Construction
Regulations 2014 shall apply with the exception of Regulation 3 and 5 (7)(b) which will come into effect on the 7th August 2015, 18 months after the commencement of these
Regulations.

2. All construction works where physical construction had started on or before the 7th of
February 2014 must comply with the Construction Regulations 2003, and such construction works are exempted to comply with Construction Regulations 2014 until the 6th August 2015 and thereafter the Construction Regulations 2014 shall apply
