2. The prize consists of one (1) complimentary ticket to attend the Saiosh Health and Safety Conference and Dinner Awards Function taking place at the Century City Conference Centre, Cape Town on 31 July 2026.
3. The prize excludes travel, accommodation, and any other personal expenses, which will be for the winner’s own account.
4. Should the winner have already registered and payed for the conference, the ticket cost will be refunded.

New draft Regulations have been published for comment on the personal use of Cannabis (20 Feb 2026). This follows the promulgation of the Cannabis for Private Purposes Act, 2024.

Key provisions of the Cannabis for Private Purposes Act, 2024.

The Act was signed into law on 28 May 2024. It provides a permanent legal framework for the private use, possession, and cultivation of cannabis by adults. Note that most of its provisions have not yet commenced and will only come into operation on a date fixed by the President. The current legal landscape is primarily governed by the Constitutional Court's 2018 ruling, which decriminalised adult private use.

• respect the right to privacy of an adult person to use or possess cannabis;
• regulate the use or possession of cannabis by an adult person;
• provide for an alternative manner by which to address the issue of the prohibited use, possession of, or dealing in, cannabis by children, with due regard to the best interest of the child;
• prohibit the dealing in cannabis;
• provide for the expungement of criminal records of persons convicted of possession or use of cannabis or dealing in cannabis on the basis of a presumption;
• amend provisions of certain laws.

The amendment of laws warrants additional mention:

• Drugs and Drug Trafficking Act, 1992
• Deletion from Schedule 2 of cannabis related items: ‘‘Dronabinol” (medication), ‘‘Cannabis (dagga)” and “Tetrahydrocannabinol’’.
  
  

• National Road Traffic Act, 1996
• Amendment of the threshold limits for substances with narcotic effects whilst driving on a public road: Alcohol, Δ9 THC (the psychologically active substance), and combinations of these.
• This affects the general public as well as professional drivers.

The draft Regulations provide the details to support implementation of the Act, such as:

1. Allowances for Adults

Under the 2024 Act and current draft regulations, adults (18+ years) may:

• Cultivate: Up to 5 cannabis plants per private place at any given time for private purposes.
• Possess in Private: Up to 750 grams of dried cannabis in a private place.
• Possess in Public: Up to 750 grams of dried cannabis, provided it is concealed from public view.
• Provide/Obtain: Share cannabis with another adult without any exchange of consideration (no money, gifts, or favours).
  
  

2. Strict Prohibitions & Offences

• No Dealing: Selling, buying, or trading cannabis remains a serious criminal offence, punishable by up to 10 years imprisonment.
• No Public Use: Smoking or consuming cannabis in a public place is prohibited.
• Vehicle Restrictions: Using cannabis while in a vehicle on a public road is an offence. Passengers must notify the driver if they are carrying cannabis, and it must be concealed. The driver of the vehicle must verify if the cannabis is of an amount permitted in regulation 2(2).
• Nuisance Smoking: Smoking in a private place near windows, doorways, or ventilation of another place where it causes a nuisance is prohibited.
  
  

3. Protection of Children

The Act places heavy emphasis on keeping cannabis away from minors:

• Storage: Adults must store cannabis in a secure space that is inaccessible to children; failure to do so carries a fine.
• Presence: Smoking cannabis in the immediate presence of a child is a criminal offence.
• Supply: Providing cannabis to a child is strictly prohibited unless prescribed by a medical practitioner.
  
  

4. Expungement of Criminal Records

• The Act provides for the automatic expungement of criminal records for individuals previously convicted of minor possession or use of cannabis under older, now-unconstitutional laws.
• If not automatic, individuals can apply to the Department of Justice and Constitutional Development for expungement.
• Details are provided in the draft Regs.
  
  

5. Important Definitions

• "Private Place": Includes buildings, houses, mobile homes, tents, and communal land used exclusively for cultivation or use by members of a community.
• "Cannabis": Specifically refers to the flowering or fruiting tops and excludes seeds, stalks, and leaves without fruit or flowers.
  
  

The Department of Justice and Constitutional Development (the Department) invites interested parties to submit written comments on the draft Regulations under the Cannabis for Private Purposes Act, 2024 (Act No. 7 of 2024) (the Act).
